The Decree comprises 3 chapters and 15 articles, outlining the recruitment and management of Vietnamese workers employed by foreign organizations and individuals in Vietnam (hereinafter referred to as employers) as per Clause 3, Article 150 of the Labour Code 2019.

| The Diplomatic Corps Service Department is tasked with leading the development of the Decree on the recruitment and management of Vietnamese workers employed by foreign organizations and individuals in Vietnam. |
The Decree establishes a unified and transparent legal framework, ensuring compliance with labor laws and related regulations, while safeguarding the legitimate rights and interests of workers.
Accordingly, before recruitment, employers must announce their needs, publicly disclose information on the National Employment Exchange, sign contracts, and report to the management authority within the stipulated timeframe. Workers are responsible for registering for management, completing general knowledge training, and complying with Vietnamese laws.
The Decree plays a role in unified management, delegating responsibilities to units such as the Diplomatic Corps Service Department, the Center for International Cooperation and Foreign Service Development, and the FOSCO Company to operate by region. It also clearly outlines the responsibilities of ministries, sectors, localities, labor leasing enterprises, and penalties for violations. The Decree will take effect in 2026, replacing Decree 152/2020/ND-CP and Decree 70/2023/ND-CP.
