Conditions for issuance of registration certificate
Section 2, Article 14-17 of the Decree outline the conditions, order, procedure for issuance, extension, admendments, re-issuance of representative office registration certificate.
Accordingly, Foreign NGOs will be granted registration certificates if they have a valid legal entity status under the law of the countries or territories they were established; have clear operation charters, guidelines and purposes in conformity with Vietnam's interests and needs; have commitment to long-term operation in Vietnam and detailed statistics on programs and projects that will be implemented in Vietnam within at least 5 years in one or more areas where the scale and nature of such programs or projects require regular, on-site operation and supervision; and have proposal for the Head of Representative Office in Vietnam.
They can submit dossiers applying for registration certificates directly, by post, or online to the Committee for Foreign NGO Affairs. Documents in foreign language shall be consularly legalized, enclosed with the lawfully certified Vietnamese translation in accordance with the law of Vietnam, except for exemption from consular legalization under international treaties that Vietnam is a member or on the principle of reciprocity.
After receiving applications, the Committee will examine the dossiers. If the dossiers are eligible, it will collect opinions from relevant ministries, agencies, as well as administrations of the localities where the foreign NGOs plan to work in.
Within 10 working days the agencies subject to collection of opinions shall reply in writing and the Committee will transfer the application of foreign NGÓ and the opinions of relevant agencies to the Ministry of Foreign Affairs for appraisal.
Within 10 working days since the reception of foreign NGOs’ applications and relevant agencies’ opinions, the Foreign Ministry will appraise the application, decide to issue or fail to issue the representative office registration certificate and notify the results to the Committee for foreign non-governmental organization affairs.
Within 30 working days since the reception of eligible dossiers, the Committee will send registration certificates directly or by post to foreign NGOs. If application is not approved, it will notify in writing to clearly state the reasons.
The decree will take effect on November 1 this year.
